Moeller Counsel
When an insurance company agrees to defend a lawsuit against its insured pursuant to a reservation of rights, a conflict of interest arises between the insurer and the insured. In such situations, Mississippi law requires an insurer to provide independent counsel chosen by the insured to defend the claims against the insured on which rights have been reserved at the insurer’s expense. The attorneys at Webb Sanders & Williams protect the rights of the insured by acting as this independent, or Moeller, counsel.
Interpleader ProActive
Our expertise includes the resolution and litigation of competing claims for life insurance proceeds and resolution of claims for liability proceeds when there is limited coverage and multiple claimants. In this context we are involved in interpleader litigation in Federal District, State Circuit and Chancery courts and providing pre-suit consultation regarding proactive steps to best protect clients when facing such situations.
